These Terms and Conditions ("Terms") govern your access to and use of the Payfrico platform, including our website, web application and any related services (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

Payfrico is a digital platform operating in Ghana that allows registered users to purchase everyday digital services, including:

  • Mobile data bundles for MTN, AirtelTigo and Telecel
  • Airtime top-ups on all Ghanaian networks
  • Television subscriptions (DSTV, GOtv and similar)
  • Electricity (ECG) and Ghana Water payments
  • Examination result checkers (WAEC, BECE and similar)
  • Virtual phone numbers, VPN subscriptions and social media promotion services

Payfrico acts as a reseller and technology intermediary. The underlying services are delivered by third-party providers and network operators. We do not operate the mobile networks, utility companies or examination bodies whose products we resell.

2. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering a binding contract to use the Service. You agree to provide accurate, current information when registering and to keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

We may suspend or terminate any account that we reasonably believe has been used for fraudulent, unlawful or abusive activity, or that breaches these Terms.

3. Wallet and Payments

3.1 Funding your wallet

To purchase services you must first fund your Payfrico wallet. Wallet funding is processed through licensed third-party payment providers using Mobile Money. Amounts credited to your wallet reflect the amount successfully received, less any applicable processing fees disclosed at the time of payment.

3.2 Nature of wallet credit

Your wallet balance is prepaid credit for purchasing services on Payfrico. It is not a deposit, savings account, investment or electronic money product. It earns no interest and is not covered by any deposit protection scheme.

3.3 Pricing

Prices displayed in the Service are inclusive of our margin and are shown before you confirm any purchase. Prices depend on wholesale rates from our suppliers and may change at any time without prior notice. The price shown at the moment you confirm an order is the price that applies to that order.

4. Orders, Delivery and Refunds

4.1 Delivery

Most orders are delivered within seconds, though delivery times depend on the relevant network or provider and may occasionally be delayed. An order marked "processing" has been accepted by the provider but not yet confirmed as delivered.

4.2 Your responsibility for order details

You are responsible for entering the correct recipient details — phone number, meter number, account number or similar. Once an order has been delivered to the details you supplied, it cannot be reversed. We are unable to recover value delivered to an incorrect number or account entered in error.

4.3 Failed orders and refunds

If an order fails or is rejected by the provider, the amount charged is automatically returned to your Payfrico wallet, normally within minutes. Where an order remains unresolved, contact support with the order reference and we will investigate with the provider.

Refunds are made to your Payfrico wallet balance. We do not, as a general rule, return funds to your Mobile Money account, except where required by law or at our sole discretion in exceptional circumstances.

5. Agent and Reseller Programme

Registered users may apply to operate a Payfrico storefront as an agent. Agents may set their own retail margin on eligible products within limits set by us, and may withdraw commissions earned to a Mobile Money account they have verified.

Agents are independent and are not employees, partners or representatives of Payfrico. Agents are solely responsible for their own customer relationships, pricing decisions, and any tax obligations arising from their activity.

6. Referral Programme

We may operate a referral programme through which users earn a commission when people they invite make qualifying purchases. Commission rates, qualifying purchases and payout conditions are set out in the Service and may be varied or withdrawn at any time. We may reverse commissions arising from fraudulent, self-referred or artificially generated activity.

7. Acceptable Use

You agree not to use the Service to:

  • Break any applicable law or regulation
  • Commit fraud, launder money, or fund unlawful activity
  • Use payment instruments you are not authorised to use
  • Attempt to gain unauthorised access to the Service or interfere with its operation
  • Resell services in a way that misrepresents your relationship with Payfrico
  • Use automated means to place orders except through an API key we have issued to you

8. Developer API

Where we issue you an API key, you are responsible for keeping it secret and for all activity carried out with it. We may rate-limit, suspend or revoke API access at any time, in particular where usage threatens the stability of the Service. API pricing and available endpoints may change.

9. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, or because of failures at third-party providers, networks or infrastructure outside our control.

10. Limitation of Liability

To the fullest extent permitted by Ghanaian law:

  • The Service is provided on an "as is" and "as available" basis
  • We are not liable for indirect, incidental or consequential loss, including loss of profit, business or data
  • Our total liability for any claim relating to an order is limited to the amount you paid for that order
  • We are not liable for failures caused by networks, utility providers, examination bodies or payment processors

Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Changes to These Terms

We may update these Terms from time to time. The updated version takes effect when published on this page, and the "last updated" date will change accordingly. Continuing to use the Service after an update constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of Ghana.
